A customer returned an item that got damaged while in his / her possession. Is the retailer obliged to take the item back? Furthermore, if the retailer does take it back can he deduct an amount for the damage?
Answer
The retailer is not obliged to take the item back. Cancellation of a sale will take place with mutual agreement.
If the retail does cancel the sale, it will be permissible to deduct from the price an amount equal to the value of damages.
